Terms of Service

The rules for using Sim Ed Practice. Last updated October 2026.

Terms of Service

1. Who you are contracting with

Sim Ed Practice is operated by Tachova Consulting Solutions LLC ("Tachova", "we", "us"), trading as Sim Ed Practice. By creating an account or continuing to use the service, you agree to these terms and confirm you are of legal age or have authority to bind your organization.

2. The service

Sim Ed Practice is an educational clinical simulation platform for nurse practitioner students and clinicians. It provides simulated patient encounters, clinical documentation practice, and structured performance feedback. It is for education only: it is not medical advice, does not certify clinical competency, and must never be used with real patient information.

3. Your account

You must provide accurate information, keep it updated, and keep your login credentials confidential. You are responsible for all activity under your account.

4. Acceptable use

You must not misuse the service, including: unlawful use; fraud or spam; infringing intellectual property; introducing malware, probing, or scraping; reverse engineering; reselling or redistributing the service; or circumventing technical limits such as credit and subscription controls.

Because Sim Ed Practice uses generative AI, you additionally must not use it to produce illegal content, deepfakes, hate speech, or malware, or to attempt to bypass safety controls. You are responsible for your inputs, for how you use AI outputs, for verifying their accuracy, and for having the rights to any content you submit. AI outputs may be inaccurate and are not suitable as professional clinical advice without qualified oversight. We may remove or restrict content, filter outputs, and suspend accounts that violate these rules. Rights holders may contact us to request removal of infringing content; repeated infringement leads to termination.

5. Intellectual property

We retain all ownership of the service and its intellectual property, including software, simulation content, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You grant us a limited license to host and process content you submit solely to provide the service.

6. Payments, subscriptions, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Memberships renew monthly until canceled; canceling keeps access until the end of the paid period. Credit packs are one-time purchases and do not expire. See our Refund Policy for refund terms.

7. Service level and warranties

We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, your results and records are handled as described in our Privacy Policy; you may request an export or deletion of your data.

9. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim, and we are not liable for indirect, consequential, or special damages such as loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury where the law does not allow it. You indemnify us against claims arising from content you submit, unlawful use, or violation of these terms.

10. General

These terms are governed by the laws of the state where Tachova Consulting Solutions LLC is organized, without regard to conflict-of-law rules. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control.
